Collection of Information
User Provided Information. We collect information that you provide directly to us, such as when you download and register a mobile application, when you create or modify your account, request customer support, or otherwise communicate with us. This information may include:
(a) your name, postal address, email address, telephone number, and any other identifier by which you may be contacted online or offline (collectively, “Personal Information”);
(b) user name, password and other registration information;
(c) transaction-related information, such as when you download or use applications from us or register for our Services; and
(d) information you provide us when you contact us for help; and (e) other information you choose to provide and enter into our system when using the Services.
Automatically Collected Information. In addition, the Services may collect certain information automatically, including, but not limited to, technical information about your device, system and application software the type of mobile device you use, your mobile device’s unique device ID, the IP address of your computer or mobile device, your operating system, traffic data, logs and other communication data, metadata and other information associated with other files stored on your device (for example, photographs, audio and video clips, and personal contacts) and information about the way you use the Services.
Our mobile application may collect location data from sources such as GPS, wireless networks, cell towers, your IP address or other similar technology once you install the application and consent to the application’s tracking your location.
If you permit our mobile application to access location services through the permission system used by your mobile operating system, we may also collect the location of your mobile device when the application is running in the foreground and the background.
You may choose to stop our collection of location data by removing the application from your mobile device.
Information Collected from Third Party Sources. We may also receive information from other sources and combine that with information we collect through our Services. For example:
(a) we may receive information about you from your employer;
(b) if your employer utilizes the SDN Driver Connect API, we may combine information from your employer’s TMS (Transportation Management System) along with information collected by the employee’s use of the mobile application.
Use of Information
We may use the information that we collect about you to:
(a) provide you with the Services, including the mobile application, the website and their contents, and any other products or services you request from SDN;
(b) fulfill any other purpose for which you provide your information;
(c) carry out SDN’s obligations and enforce SDN’s rights arising under any agreement between SDN and you;
(d) notify you when updates to the Services are available;
(e) send or facilitate communications between you and other users of the Services, for example between a driver and fleet operator, at your direction in connection with your use of certain features of the Services;
(f) determine how the Services are being used and how they and other products and services can be improved. SDN will disclose your Personal Information for the sole purpose of providing Services to you.
We may share your Personal Information and Location Information with other users of our Services to provide Services
(a) as requested by you or
(b) with your employer (or similar entity) and any necessary third parties engaged by us or your employer, if you participate in any of our enterprise solutions.
You control who will receive your Location Information.
SDN may aggregate any information that is not Personal Information from all users of the Application (“Aggregate Data”). SDN may disclose Aggregate Data without restriction.
In addition, SDN may disclose your information
(a) to SDN’s affiliates,
(b) to contractors, service providers and other third parties SDN uses to support its business,
(c) to a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of SDN’s assets,
(d) to fulfill the purpose for which you provide it, (v) for any other purpose disclosed by SDN when you provide the information,
(e) with your consent,
(f) to comply with any court order, law or legal process, including to respond to any government or regulatory request,
(g) to carry out SDN’s obligations and enforce SDN’s rights arising under this any agreement between SDN and you and
(h) if SDN believes disclosure is necessary or appropriate to protect the rights, property, or safety of SDN, our customers or others.
SDN may share your information with third-party business partners who assist SDN in providing its products and services; provided, that SDN will not provide such third-party business partners with your Personal Information without your consent.
Additionally, SDN may share your information with your employer or any other Person for which you provide a fleet identification number in your use of the Services.
You can stop all collection of information by the mobile application easily by uninstalling the mobile application.
You may use the standard uninstall processes as may be available as part of your mobile device or via the mobile application marketplace or network.
You can stop collection of information by any other of our Services by ceasing to use such Services.
Data Retention Policy, Managing Your Information
We will retain User Provided data for as long as you use the Application and for a reasonable time thereafter.
We will retain Automatically Collected information for up to 24 months and thereafter may store it in aggregate. If you’d like us to delete User Provided Data that you have provided via the Services, please contact us at email@example.com and we will respond in a reasonable time.
Please note that some or all of the User Provided Data may be required in order for the Services to function properly.
We are concerned about safeguarding the confidentiality of your information. We provide physical, electronic, and procedural safeguards to protect information we process and maintain.
For example, we limit access to this information to authorized employees and contractors who need to know that information in order to operate, develop or improve our Services.
Please be aware that, although we endeavor provide reasonable security for information we process and maintain, no security system can prevent all potential security breaches.
If you reside outside the United States your information will be transferred, processed and stored there under United States privacy standards.
